Dick's
Sporting Goods Assistant Store Managers (Hardlines,

Assistant Store Managers claim that they
worked overtime but were not paid for it
because Dick's Sporting Goods misclassified
them as exempt employees, in violation of
fair wage practices. They claim that they
should have been classified as non-exempt
employees because they performed little, to
no, managerial duties, and primarily spent
their time performing non-managerial tasks
throughout the work day like cleaning,
stocking, and running cash registers, and
other non-management things. They claim that
they spent a greater percentage of their
workday performing the same tasks as hourly
employees, but unlike the hourly employees,
the Assistant Store Managers worked
extremely long, hard hours, but were not
paid overtime. As a result, the they believe
they were entitled to be paid overtime for
their time pursuant to both federal and
state law. The classification of the
Assistant Managers as exempt from overtime
wages has very often been determined to
violate the law.
