New York City Council Bans Pre-Employment Credit Checks

There are some exceptions to the new law,
however, the exceptions apply to relatively
few people. Unless it is required by State
law, Federal law, or the job is a matter of
public trust, then checking credit history
in employee screening is illegal.
Unfortunately, employers will continue using
these practices until they are caught and
held accountable for breaking the law. There
will be intense litigation over exactly what
employees are exempt from the new law.
The New York City Council took a big step
toward ensuring the job market is a level
playing field for applicants. Previous
financial hardships should not hold
potential candidates back from jobs
unnecessarily.
