Assistant Store Mangers Overtime

Assistant Store Mangers were working
overtime but were misclassified as exempt
and not paid for overtime hours in violation
of fair wage practices. The Assistant Store
Mangers did little, to no managerial duties
and primarily did non-management tasks
throughout the work day. The Assistant Store
Mangers would predominantly clean, stock,
fold clothing, run cash registers, and other
non-management duties. The Assistant Store
Mangers spent the greater percentage of
their day doing the same tasks that hourly
employees would do. Assistant Store Mangers
working for Kohl's worked extremely long,
hard hours but were not paid overtime. The
Assistant Store Mangers were entitled to be
paid fairly for their time pursuant to both
federal and state law. Sadly, as a result of
being classified as "management," Kohl's
Assistant Store Mangers were not paid their
overtime wages. The classification of the
Assistant Mangers as exempt from overtime
wages has very often been determined to
violate the law.
