Walmart Biased Against Lesbians
The U.S.
Equal Employment Opportunity Commission has
found Walmart guilty of discriminating
against one of their lesbian employees. The
company has been ordered to help an employee
with her wife’s medical bills that now total
more than $100,000. This is yet another
occasion where the largest employer in the
country has been found by a Federal court or
state agency to have violated employee’s
rights.
The basis
of the decision was that Walmart denied an
employee of their civil rights. It is
against Federal law to treat an employee
differently based on their sex.
Employee rights attorneys in New York
and throughout the US anticipate that this
case will set a lasting precedent for people
involved in same-sex relationships.
Corporations have not kept pace with the
changing laws and rights in our society.
Now, the courts are making these companies
catch up and do the right thing for their
employees.
This
decision goes back to health issues that
arose several years ago. Unfortunately, too
many civil rights victims like these assume
they cannot recover for past
discriminations. They take no action to
speak with an experienced New York employee
rights attorney and wind up having to bear
the cost themselves. Statutes of limitations
vary depending on the type of violation that
occurred. In this case, the plaintiff was
able to recover for a civil rights violation
that Walmart committed more than three years
in the past.
Corporations like Walmart continue to engage
in business practices that take advantage of
employees because too few employees take a
stand. Unfortunately, employers will
continue to violate
employee rights until enough wronged
employees make it no longer profitable for
them to do so. As a general rule of thumb,
if you feel like your civil rights have been
violated by your employer, there is a good
chance that they have been. To find out for
certain, and to learn about your rights as a
victim, speak with an experienced NYC
employee rights attorney as soon as possible
after the incident.
